A.- INTRODUCTION

The present specific conditions of the online store operated by SMARTNET, SL (hereinafter: THE STORE), are offered as information prior to the purchasing process and complement the general terms and conditions that regulate the general use of the website accessible through https://store.racingclubferrol.net/

Making any purchase through THE STORE necessarily entails acceptance of the general terms and conditions of access and use of the SMARTNET SL website, as well as of these specific terms and conditions, without objection or reservation of any kind.

B.- GENERAL INFORMATION:

SMARTNET, SL (hereinafter: SMARTNET), is a Spanish company, registered in the Commercial Registry of Madrid (Volume: 28,559 Folio: 97 Section: 8 Page: M-514169 Entry 1), with CIF number: B-86133360 and registered office in Madrid (28010), c/ Fortuny, 51.

Any incident, complaint or claim related to a purchase made in THE STORE must be communicated to the email address: tienda.rcferrol@smart-keting.com

C.- ORDER PROCESSING:

Orders must be processed by THE STORE, where the user will be informed prior to the completion of each purchase of the exact amount of each of their orders, including the shipping costs associated with each of them.

Only persons aged at least 16 years old may process orders through THE STORE. Users who use THE STORE guarantee that they are at least that age and that all registration data provided to SMARTNET is true. In any case, the User will be solely responsible for any false or inaccurate statements made and for any damages caused to SMARTNET or third parties due to the information provided.

D.-PRODUCT AVAILABILITY:

THE STORE displays information on stocks and available sizes of products communicated, in each case, by the manufacturer or distributor of the same.

SMARTNET makes efforts to keep the information on stock and sizes up to date based on the information provided at any given time by the manufacturer or distributor, but cannot guarantee at all times that the information is true as it is external information, supplied by third parties.
As a general rule, as long as the desired product is available, shipments are made within 4 to 5 business days, except in the case of personalized products based on customer specifications, in which case, shipment is made within 12 to 14 days after the order is placed.

If for any reason it is not possible to supply any of the products included in an order, SMARTNET will contact the user as soon as possible to inform them of this circumstance and will proceed to refund the price of the order, as well as the shipping costs in the proportion to which the user is entitled according to the shipping cost tables published at any given time on the website.

In cases where it is not possible to supply an order consisting of one or more products due to the complete unavailability of all of them, SMARTNET will proceed to fully refund the amount paid for the order, including any shipping costs that may have been charged to it.

In cases where it is not possible to supply one or more products included in an order that includes additional products that can be supplied, SMARTNET will fully refund the amounts paid for the unavailable products, but will retain the amounts corresponding to the value of the products that can be supplied, as well as the shipping costs associated with their delivery.

E.- WARRANTIES OFFERED:

THE STORE offers a guarantee on the products sold, under the legally established terms.

In any case, and unless proven otherwise, it will be understood that the products comply with the contract provided that they meet all the requirements stated below, unless due to the circumstances of the case any of them are not applicable:

  1. They conform to the description made by the seller and possess the qualities of the product that the seller has presented to the consumer and user in the form of a sample or model.
  2. They are suitable for the uses to which products of the same type are normally intended.
  3. They are suitable for any special use required by the consumer and user when this has been made known to the seller at the time of entering into the contract, provided that the latter has admitted that the product is suitable for such use.
  4. They present the usual quality and performance of a product of the same type that the consumer and user can reasonably expect, given the nature of the product.

In cases of proven non-compliance of the product with the contract, THE STORE will proceed - where appropriate and as appropriate - to repair, replace, reduce the price or terminate the contract, procedures that will be free of charge for the consumer and user.

F.- PRODUCT RETURNS - RIGHT OF WITHDRAWAL:

The user has the option of exercising his right to withdraw from the purchase of products made in THE STORE within seven business days according to the calendar of his locality, from receipt of the order at the chosen delivery address.

Returns of products will only be accepted if they are in perfect condition, have not been used and retain their original labels, packaging and, where applicable, original documentation and accessory elements, also in perfect condition.

Returns of products customized according to customer specifications or made according to customer specifications will not be accepted. Likewise, for hygiene reasons, returns of intimate clothing items (underwear and swimwear) or masks will not be accepted.

SMARTNET reserves the right to deny the right to return products in cases of violation of the provisions of these specific conditions.

HOW TO EXERCISE THE RIGHT OF WITHDRAWAL:

To proceed with product returns, you must - within fourteen business days following receipt of the order - send an email to the address: tienda.rcferrol@smart-keting.com a statement to this effect indicating the affected order number as well as the product or products to be returned.

If the return is appropriate and you are so instructed by customer service, you must send the product(s) you wish to return to our facilities.

Each product to be returned must be in perfect condition, unused and with all its labels, packaging and, where applicable, documentation and original accessory elements that came with it.

Except in cases of receiving factory-defective products and provided that said defects were not due to improper handling or use by the user, the shipping costs associated with the return will be the exclusive responsibility of the buyer. SMARTNET will refuse to accept any return sent on a “cash on delivery” basis.

Once the buyer has received the request to exercise his right of withdrawal and is in possession of the goods to be returned, SMARTNET will examine the products received and will contact you to inform you of its conclusions regarding your request.

In this case, the refund of amounts paid for the purchase of the returned product will be carried out as soon as possible and, in any case, within thirty days of receipt of the product by SMARTNET , always subject to the provisions of these specific terms and conditions. Likewise, in this case, the amounts initially charged for the order in the form of Shipping Costs will be deducted from the total amount to be refunded. If the customer benefited from a free shipping promotion and this is no longer applicable to the resulting order when the return is made, the amount that would correspond to said concept (without applying the promotion) will be deducted from the amount to be refunded.

For orders placed outside the Peninsula and the Balearic Islands, the costs generated by the return of the order will be fully assumed by the customer, including customs export/import costs if the order is subject to them.

G.- PRODUCT RETURNS - FACTORY DEFECTS:

The buyer has the option of returning products received with defects or factory defects, within 24 hours of receiving the order.

Returns of products will only be accepted if they are in perfect condition, have not been used and retain their original labels, packaging and, where applicable, original documentation and accessory elements, also in perfect condition, with the exception of the alleged defect or fault.

SMARTNET reserves the right to deny the right to return products in cases of violation of the provisions of these specific conditions.

HOW TO MAKE RETURNS:

To proceed with the return of a product with a factory defect, you must - within 24 hours of receiving the order - send an email to the address: tienda.rcferrol@smart-keting.com a statement to this effect indicating the affected order number as well as the product or products to be returned and a detailed list of the defects noted in them.

SMARTNET will then contact you to arrange for the return of the products to be collected from your home. Except for any defect or fault noted, each product to be returned must be in perfect general condition, unused and with all its labels, packaging and, where applicable, documentation and original accessories that came with it.

Except in cases of receiving factory-defective products and provided that said defects were not due to improper handling or use by the user, the shipping costs associated with the return will be the exclusive responsibility of the buyer. SMARTNET will refuse to accept any return sent on a “cash on delivery” basis.

Once the buyer has received the request to return a product with a defect or manufacturing fault and is in possession of the returned merchandise, SMARTNET will examine the products received and will contact you to inform you of its conclusions regarding your request.

Once the existence of a manufacturing defect has been verified and provided that the product has not been used and retains all its labels, packaging and, where applicable, documentation and original accessory elements that came with it, SMARTNET will proceed to process with the corresponding manufacturer or distributor the replacement of the same with another of identical characteristics.

If replacement is not possible, SMARTNET will inform the user of this circumstance and will proceed to pay the user the amount corresponding to the purchase of the product with a proven factory defect or fault.

In such case, the refund of amounts paid for the purchase of the returned product will be carried out as soon as possible and, in any case, within thirty days, always subject to the provisions of these specific terms and conditions. Likewise, in such case, the costs corresponding to the return shipping will be borne by the user.

H.- REQUEST FOR PRODUCT EXCHANGES DUE TO SIZE ERRORS

If the user wishes to exchange the product due to a size error, he/she must return it, exercising his/her right of withdrawal, in the cases and conditions indicated above.

I.- SHIPPING COSTS:

Once the products are added to the basket and the shipping address is entered, the shipping costs for the requested destination will be calculated.
Shipments within mainland Spain with an amount greater than €100 will be free. Balls from regional federations are exempt from this condition. (See conditions in the description of these products).

Customs clearance will be the responsibility of the customer upon receipt of the goods in all countries outside the European Union.

J.- STORE PICKUP:

Customers who select a purchase option with Pickup in Store, if available, will receive an email confirming the availability of their order in store. They have a period of 90 days, after which the order will be automatically cancelled and the reservation of the products will be lost. In the case of a personalized product, the order cannot be cancelled or refunded.
